My Lasting Plan

Terms of Use

Last updated: 17 October 2026

1. About these terms

This website is operated by My Lasting Plan Pty Ltd (ABN 35 694 490 796) — "My Lasting Plan", "we", "us", "our".

These terms apply to your use of this website. By using it, you agree to them. If you do not agree, please do not use the site.

These terms cover this website only. TrustCircle, our financial safety tool, is a separate service with its own terms of service, which you agree to when you sign up for it. Nothing in these terms applies to TrustCircle.

2. What this website is for

This website provides general information about financial safety for older Australians: self-help guides, information about our free community workshops, news, and the opportunity to join the waitlist for TrustCircle.

3. Our guides and other content are general information only

The guides, articles, workshop materials and other content on this website are general information only. They are not legal advice, financial advice, medical advice, or professional advice of any kind.

We do not know your circumstances. Nothing on this site takes account of your particular situation, needs or objectives.

Our content is written with New South Wales law in mind. Much of it will be broadly useful elsewhere, but laws about powers of attorney, guardianship and estates differ between states and territories, and they change over time. If you are outside New South Wales, check the position where you live before acting.

Before acting on anything you read here, get your own advice from a qualified solicitor, financial adviser, accountant or other appropriate professional.

Using this website does not create a lawyer-client, adviser-client, or any other professional relationship between you and us.

4. Our workshops

We run free educational workshops, usually hosted by community organisations, clubs and retirement villages.

Workshops are general educational sessions. Nothing said at a workshop is personal advice.

Where a workshop is hosted by another organisation, bookings, attendance and venue arrangements are handled by that organisation, not by us.

5. Joining the waitlist

Joining the waitlist is free and creates no contract between us. It does not guarantee you a place in the pilot, and it does not commit you to buying anything.

We have not set a price for TrustCircle. When the pilot opens we will tell you what it costs, and you can decide then. The pilot will have its own terms, which you agree to at that point.

We may limit the size of the first group, and we may not be able to offer a place to everyone who joins the list. If the pilot does not go ahead, we will tell you and delete your details.

6. We cannot investigate or intervene

If someone is in immediate danger, call 000.

My Lasting Plan is not a crisis service, an investigator, or a reporting body. We cannot investigate suspected financial abuse, contact a bank on your behalf, or intervene in a family situation. We have no power to do any of those things.

If you contact us about a situation that worries you, we will point you to organisations that can help — and you can reach them directly at any time by calling 1800 ELDERHelp on 1800 353 374.

Nothing you send us creates an obligation on us to act.

7. Information about other people

Please do not send us personal information about anyone else — including allegations about a family member, carer or adviser — unless you have their permission or a proper reason to.

We are not able to verify what we are told, we do not investigate, and we may not be able to act on it. Anything you send us is handled under our Privacy Policy.

8. Your information

When you join the TrustCircle waitlist or send us a workshop enquiry, you give us personal information. How we handle it is set out in our Privacy Policy, which forms part of these terms.

Please give us accurate information, and only submit someone else's details if you have their permission to do so.

9. Our content

All content on this website — including the guides, articles and images — is ours or used with permission, and protected by copyright. The My Lasting Plan and TrustCircle names and our logo are ours. You may not use them in a way that suggests we endorse you or are connected with you.

You may read, print and download our guides for your own use, and share links to our pages.

You may also pass our guides on — unaltered and with our name on them — to anyone who might find them useful, including your clients or members. You may not charge for them, change them, remove our name, or present them as your own work.

If you do share them, please share the warning with them. Our guides are general information, written to help people understand their options — not to replace advice. Anyone acting on them should talk to a solicitor, accountant, financial adviser or a community organisation that can look at their own circumstances. And they are written with New South Wales law in mind, so anyone elsewhere in Australia should check the position where they live.

We are not responsible for how anyone else uses or passes on our material, or for any advice given alongside it. Sharing our guides does not make anyone our agent, partner or representative, and does not mean we endorse them.

10. Acceptable use

You must not use this website to:

  • break any law
  • interfere with the site's operation or security, or attempt to gain unauthorised access to any part of it
  • collect information about other users
  • submit false, misleading, abusive or unlawful content through our forms
  • send automated queries, scrape content, or place unreasonable load on the site

11. Links to other websites

Where this website links to another website — for example a government agency, a support organisation, or our own TrustCircle service — we do not control that website and are not responsible for its content, accuracy or availability. A link is not an endorsement.

12. Availability

We try to keep the site available and accurate, but we do not guarantee it will be uninterrupted, error-free, or free of viruses. We may change, suspend or withdraw any part of the site at any time.

13. Accessibility

We have designed this website with older Australians in mind — plain language, large text, generous spacing, and buttons big enough to tap easily.

We know we will not have got everything right. If something here is hard for you to use, please tell us at hello@mylastingplan.com and we will endeavour to address your concerns.

14. Liability

Nothing in these terms excludes any rights you have under the Australian Consumer Law, including the consumer guarantees, which cannot be excluded.

Subject to that, and to the extent the law allows:

  • we provide this website and its content "as is"
  • we are not liable for any loss arising from your use of, or reliance on, this website or its content
  • where our liability cannot be excluded, it is limited to re-supplying the relevant content or paying the cost of having it re-supplied

15. Changes to these terms

We may update these terms. The current version is always on this page, with the date it was last updated at the top. Continuing to use the site after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
