Welcome to My Lasting Plan (‘we’, ‘us’, or ‘our’).
These Terms of Use (‘Terms’) govern your access to and use of the My Lasting Plan website and platform (the ‘Service’). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

  1. Eligibility
    By registering for an account and using our Service, you represent and warrant that at the time of registration:
    Residency: You are a resident of Australia;
    Age: You are at least 18 years of age;
    Capacity: You have the legal capacity to enter into a binding contract.
    We reserve the right to refuse the Service to any person or entity who does not meet these criteria.
  2. The Service (Nature and Limitations)
    2.1 Description of Service My Lasting Plan is a digital platform designed for aggregating financial data and setting rules and alerts. It acts as an informational tool to help you organise your financial life and serves as an Automated Warning System to help you detect financial irregularities.
    2.2 NO FINANCIAL OR LEGAL ADVICE Important: The content, alerts, and tools provided by My Lasting Plan are for informational purposes only.
    We are not a financial adviser, legal practitioner, or tax professional.
    The Service does not constitute financial, legal, or tax advice.
    Action Required: If the Service highlights a suspicious transaction or irregularity, it is your responsibility to follow up, investigate, and seek professional advice. We do not automatically stop transactions or intervene with your bank.
  3. User Accounts & Security
    3.1 Registration & Information Accuracy To access the Service, you must register for an account.
    Your Profile Data: You agree to provide accurate, current, and complete contact and identity information (such as your name, email address, and phone number) during the registration process.
    Financial Data: We acknowledge that the financial data displayed in your account is retrieved via the Consumer Data Right (CDR). We rely on the accuracy of the data provided by your financial institutions and our accredited partners.
    3.2 Account Security
    Confidentiality: You must keep your username and password confidential and not provide them to anyone else.
    Liability: You are responsible for safeguarding your login details and for any activity that occurs under your account.
    Notification: You must immediately change your password and let us know if you believe your password is known to someone else or is at risk of unauthorised use.
  4. Subscription Fees and Refunds
    4.1 Subscription The Service is accessed via a paid subscription. You agree to pay the fees associated with your chosen plan. We reserve the right to change our fees or introduce new fees in the future.
    4.2 Refund Policy
    General Rule: If you terminate or cancel this agreement, any subscription fees will be non-refundable, and you will not be entitled to receive a refund unless we otherwise agree.
    Incorrect Charges: If you consider that we have incorrectly charged a fee, you should contact us. We will reverse or refund any incorrect fee or charge.
    Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. To the maximum extent permitted by law, our liability for services supplied for a fee is limited to the resupply of the service or payment of the cost of doing this.
  5. User Conduct
    You must only use the Service for lawful purposes. You are strictly forbidden from using the Service in a manner that:
    Violates Rights: Violates or infringes the rights of others including their intellectual property, privacy, and publicity rights;
    Unlawful Behaviour: Is unlawful, fraudulent, threatening, discriminatory, abusive, or defamatory;
    Impersonation: Impersonates any person or misrepresents your identity or affiliation with any person (including us);
    Commercial Exploitation: Exploits any of our Site materials for commercial purposes without our prior written permission;
    Viruses & Malware: Affects the functionality of the Service (for example, by transmitting a computer virus or other harmful component); or
    Reverse Engineering: Attempts to copy, decompile, reverse engineer, or disassemble the source code of the Service.
    We reserve the right to remove or delete any content you put on the Service if we reasonably consider it breaches any of these prohibitions.
  6. Intellectual Property
    All rights in the Service, including all software, source code, algorithms, designs, user interfaces, documentation, trademarks, logos, and content (collectively, “IP”), are and remain the exclusive property of My Lasting Plan or our licensors.
    We grant you a limited, non-exclusive, revocable, non-transferable licence to access and use the Service solely for your personal, lawful, and non-commercial use.
  7. Data Accuracy and Liability
    7.1 “As Is” Basis We provide the Services using reasonable care and skill. However, we do not guarantee the Services will be uninterrupted, error-free, or always available.
    7.2 Reliance on Consumer Data Right (CDR) Our Service relies on the Consumer Data Right (Open Banking) system to aggregate your financial information.
    Accredited Data Recipient: We utilise Fiskil Pty Ltd (“Fiskil”) as our Accredited Data Recipient to securely connect to your financial institutions. By using the Service, you authorise Fiskil to retrieve your data on our behalf.
    Accuracy Disclaimer: We do not warrant the accuracy or completeness of this financial data, as it is retrieved directly from your financial institutions via Fiskil. We are not responsible if the data displayed is incorrect, delayed, or incomplete due to errors by your financial institution, Fiskil, or the CDR gateway.
    7.3 Limitation of Liability To the maximum extent permitted by law:
    Liability Cap: Our total aggregate liability to you for all claims arising out of or in connection with the Services or these Terms is limited to the amount you paid us for the Service in the 12 months preceding the claim (or, if no fees were paid, AU$100).
    Exclusions: We are not liable for any special, indirect, incidental, punitive or consequential loss or damage, or for loss of profits, revenue, goodwill, or opportunity.
    This limitation does not apply to fraud, wilful misconduct, or any other liability that cannot lawfully be excluded.
  8. Termination
    8.1 Termination by Us We may suspend or terminate your access to our Services:
    Immediately: if there is a material security threat, misuse, or suspected fraudulent activity; or
    With Notice: if you breach these Terms and do not remedy the breach within a reasonable timeframe (e.g., 7 days).
    8.2 Termination by You You can terminate this agreement at any time by giving us notice in writing or cancelling via your account settings.
  9. Changes to These Terms
    We may make changes to these Terms.
    Minor Changes: Updates that are not materially adverse to you may be made without notifying you, by updating the version on the website.
    Material Changes: Where we make changes that are materially adverse to you (or increase your fees), we will provide at least 30 days’ prior notice.
  10. Governing Law
    These Terms are governed by the laws of New South Wales, and the parties submit to the non-exclusive jurisdiction of the courts of that State.
